Recovery of GIDC from industry: PHC directs federal govt, OGRA to submit reply

PESHAWAR: A divisional bench of Peshawar High Court comprising of Justice Syed Arshad Ali and Justice Khurshid Iqbal has stopped Sui Northern Gas Pipelines Limited (SNGPL) from cutting off the gas supply of industries and recovering GIDC through utility bills.

The Petitioners, M/s. Peshawar Ceramics, M/s. Khazana Sugar Mill and M/s. Amin Soap while hearing the case against recovery of GIDC arrears. The Petitioners challenged the recovery of GIDC arrears by the Federal Government and SNGPL.

The counsel Farooq Afridi and Sajjad Hussain Advocate argued the case on behalf of the Petitioners. The counsels contended that GIDC arrears could not be recovered from the Petitioners before framing of GIDC Rules by Federal Government under GIDC Act 2015 as there are certain ambiguities in the GIDC Act 2015 which needs to be clarified through framing of Rules.

Before such clarifications, GIDC arrears could not be calculated and collected.
The Divisional Bench of PHC comprising of Justice Syed Arshad Ali and Justice Dr. Khurshid Iqbal directed Federal Government & OGRA to submit reply and also directed the Petitioners to pay current monthly bill of the gas without GIDC arrears.
