Ban on export of chicken to Afghanistan: PHC directs govt to submit reply

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Rooh-ul-Amin and Justice Shahid Khan ordered Government of Khyber Pakhtunkhwa to submit reply in case regarding imposition of ban on export chicken to Afghanistan till 8th September, on Wednesday.

The writ filed by poultry dealer Noorbad while Zafar Tahirkheli Advocate informed that Director General (DG) Livestock Khyber Pakhtunkhwa has imposed ban export of chicken to Afghanistan beyond his jurisdiction.

The counsel argued that Federal Ministry Commerce and Industry is competent forum for imposition of ban on exports while ban has impacted business because Poultry Association Khyber Pakhtunkhwa is exporting most chicken to Afghanistan.

The counsel further argued that if provincial government has concern about export of chicken to Afghanistan then it should be uphold with federation while Ministry of Commerce and Industry will take the decision.

The petitioner’s lawyer informed that ban was imposed by Director General Livestock neither by provincial government which is impacting legal business while Justice Rooh-ul-Amin remarked that why all traders are exporting chicken from Khyber Pakhtunkhwa and added that why not from Punjab’s quota exports are made to Afghanistan.

Moreover, Justice Rooh-ul-Amin observed that chicken prices are increasing due to export of chicken to Afghanistan from Khyber Pakhtunkhwa while counsel Zafar Advocate informed that export is continued from Chaman border and other cross points but ban is imposed only Torkham which illegal because DG has imposed beyond his jurisdiction, further hearing is adjourned till 8th September.
