Appointment of Aftabas AC: PHCBA files writ seeking inquiry, trial of FIR

PESHAWAR: Peshawar High Court Bar Association (PHCBA) filed writ petition against posting of suspended Additional Assistant Commissioner Aftab Ahmad involved on torturing Advocate Supreme Court as AC Tangi without departmental inquiry, on Tuesday.

PHCBA president Rehman Ullah and Farooq Afridi Advocates filed writ petition on behalf of the association in which Chief Secretary Khyber Pakhtunkhwa, Secretary Establishment and AC Tangi Aftab Ahmad.

The petition argued that AAC Aftab Ahmad along with security guards had tortured Ghuffran Shah Advocate at Chamkani which is against law while First Information Report was registered against Aftab Ahmad on court’s order.

The petition stated that on 14th June suspension orders of Aftab Ahmad was issued but no inquiry had conducted against him and now appointed as AC Tangi while added that it is also illegal and beyond the jurisdiction that inquiry did not initiated against him.

The writ petition rises questions that Is suspension notification was bogus? Is appointment of Aftab Ahmad as AC without reinstating in service does not laying beyond the jurisdiction provided by law? And is that fair that public servant torture citizen and did not face penalty while Article 25 of Constitution states that every citizen is equal before law.

The writ petition requested PHC to direct competent to initiate inquiry against Aftab Ahmad and order to start trial of FIR registered against him.
